Strata Studio, bu Sözleşmenin diğer hükümleri saklı kalmak kaydıyla, aşağıdaki sınırlamalara tabi olarak Hizmetlere erişmeniz ve bunları kullanmanız için size münhasır olmayan, devredilemez, alt lisansı verilemeyen ve geri alınabilir sınırlı bir kullanım hakkı tanır. Bu hak kapsamında Hizmetlere yalnızca kişisel ve ticari olmayan amaçlarla erişebilir ve bunları kullanabilirsiniz.

Hizmetlerin ticari amaçla kullanımı yasaktır. Hizmetleri kişisel kullanımınız kapsamında kullandığınızı kabul edersiniz.

Bu Sözleşmeyle size tanınan haklar aşağıdaki kısıtlamalara tabidir. Şunları yapmamayı kabul edersiniz:

• Hizmetleri lisanslamak, satmak, kiralamak, devretmek, dağıtmak, kopyalamak, kamuya iletmek, yayımlamak veya başka şekilde ticari olarak kullanmak;
• Hizmetleri tamamen veya kısmen değiştirmek, uyarlamak, türev çalışma oluşturmak, tersine mühendislik yapmak, kaynak koda dönüştürmek veya çözümlemek;
• Benzer veya rekabet eden bir hizmet ya da uygulama geliştirmek amacıyla Hizmetlere erişmek;
• Strata Studio'nun bilgi sistemlerine yetkisiz erişmek, saldırı başlatmak veya zararlı yazılım yaymak;
• Strata Studio'nun siber güvenlik amacıyla kullandığı yazılımları devre dışı bırakmak veya değiştirmek;
• Strata Studio adına izinsiz davet, reklam veya e-posta göndermek ya da marka ve logolarını yetkisiz kullanmak;
• Hizmetleri yürürlükteki mevzuata, üçüncü kişi haklarına veya genel ahlaka aykırı şekilde kullanmak.

Hizmetlerimizin bazıları, sağladığınız metin, görsel, ses veya diğer girdiler ("Girdiler") temelinde yapay zeka kullanarak içerik ("Çıktılar") üretir.

Girdileriniz

Girdileri sağlamak için gerekli haklara sahip olduğunuzu ve bunların üçüncü kişilerin fikri mülkiyet, gizlilik veya diğer haklarını ihlal etmediğini beyan edersiniz. Hizmetleri çalıştırabilmemiz için Girdilerinizi işlemek üzere bize gerekli izni vermiş olursunuz.

Çıktılar

Yürürlükteki mevzuatın izin verdiği ölçüde ve bu Sözleşmeye uymanız koşuluyla, Hizmetler aracılığıyla ürettiğiniz Çıktıları kullanma hakkına sahip olursunuz. Yapay zeka çıktılarının doğası gereği benzer Çıktıların başka kullanıcılar için de üretilebileceğini kabul edersiniz.

Hizmetler size satılmaz; yalnızca yukarıda açıklanan kullanım hakkı tanınır. Hizmetlere ilişkin tüm haklar, mülkiyet ve menfaatler — yazılım, kaynak kodu, tasarımlar, grafikler, arayüzler, modeller, metinler, ses ve görsel öğeler ile ilgili tüm fikri mülkiyet hakları dahil — Strata Studio'ya veya lisans verenlerine aittir.

Bu Sözleşmede açıkça izin verilmedikçe Hizmetlerde görüntülenen telif hakları, ticari markalar ve diğer mülkiyet haklarını kopyalayamaz, kullanamaz, yeniden yayımlayamaz, değiştiremez veya dağıtamazsınız.

Hizmetler, abonelikler ve uygulama içi satın almalar dahil ücretli özellikler sunabilir.

Abonelikler ve otomatik yenileme

• Aboneliğiniz, siz iptal etmediğiniz sürece her dönem sonunda otomatik olarak yenilenir ve seçtiğiniz dönem ücreti tahsil edilir.
• Yenilemeyi durdurmak için aboneliğinizi, mevcut dönemin bitiminden en az 24 saat önce ilgili uygulama mağazasının hesap ayarlarından iptal etmelisiniz.
• Sunulması halinde, ücretsiz deneme süresi bitmeden iptal etmezseniz ücretli aboneliğe geçilir.

Ödemeler ve iadeler

• Tüm ödemeler, Apple App Store ve Google Play gibi platform sağlayıcıları ("Platformlar") aracılığıyla gerçekleştirilir. Satın alma yaparak ilgili Platformun koşullarını da kabul etmiş olursunuz.
• İadeler, ilgili Platformun politikalarına tabidir ve kural olarak Platform tarafından yürütülür.
• Fiyatlar ve kullanılabilirlik bildirimli veya bildirimsiz olarak değiştirilebilir; değişiklikler mevcut abonelik döneminizi etkilemez.

Hizmetler "olduğu gibi" ve "mevcut haliyle" sunulur; herhangi bir açık veya zımni garanti verilmez. Strata Studio; Hizmetlerin kesintisiz, hatasız veya güvenli olacağını, kusurların giderileceğini ya da Çıktıların doğru veya belirli bir amaca uygun olacağını garanti etmez.

Yürürlükteki mevzuatın izin verdiği azami ölçüde, Strata Studio; gelir kaybı, kâr kaybı veya iş kesintisi dahil olmak üzere dolaylı, arızi, sonuç niteliğindeki veya cezai zararlardan sorumlu olmayacaktır. Strata Studio'nun bu Sözleşmeden doğan toplam sorumluluğu, talebinizin doğduğu tarihten önceki altı (6) ay içinde Hizmetler için bize ödediğiniz tutarı aşamaz. Bu süre içinde herhangi bir ödeme yapmadıysanız, tek çözüm yolunuz Hizmetleri kullanmayı bırakmaktır.

Hizmetleri kullanımınızdan, sağladığınız içerikten veya bu Sözleşmeyi ihlalinizden kaynaklanan ya da bunlarla ilgili olarak üçüncü kişilerce ileri sürülen talep, dava ve masraflara (makul avukatlık ücretleri dahil) karşı Strata Studio'yu savunmayı, tazmin etmeyi ve zarar görmesini önlemeyi kabul edersiniz.

Strata Studio, bu Sözleşmenin hükümlerini dilediği zaman değiştirme hakkını saklı tutar. Güncel sürüm her zaman bu sayfada yayımlanır. Değişikliklerin yürürlüğe girmesinden sonra Hizmetleri kullanmaya devam etmeniz, güncel sürümü kabul ettiğiniz anlamına gelir.

Bu Sözleşme, Hizmetleri etkinleştirdiğiniz veya kullanmaya başladığınız tarihte yürürlüğe girer. Hizmetleri kullandığınız sürece geçerli kalır; Hizmetleri kullanmayı bırakmanız veya Strata Studio tarafından feshedilmesi halinde sona erer. Bu Sözleşmeyi ihlal etmeniz halinde Strata Studio, erişiminizi bildirimsiz olarak askıya alabilir veya sonlandırabilir.

Bu Sözleşme ve buna ilişkin tüm uyuşmazlıklar, kanunlar ihtilafı kurallarına bakılmaksızın Türkiye Cumhuriyeti hukukuna tabidir. Bu Sözleşmeden doğan veya bununla ilgili tüm uyuşmazlıklarda İstanbul (Çağlayan) Mahkemeleri ve İcra Daireleri yetkilidir. Tüketici işlemleri bakımından tüketicinin yerleşim yerindeki tüketici mahkemeleri ve hakem heyetlerinin yetkisi saklıdır.

Strata Studio size, web sitesi veya uygulama içi duyurular ya da sağladığınız e-posta adresi aracılığıyla bildirimde bulunabilir. Bu Sözleşme kapsamındaki tüm bildirimlerinizi hello@stratastudio.app adresine iletebilirsiniz.

Subject to the other provisions of this Agreement, Strata Studio grants you a non-exclusive, non-transferable, non-sublicensable, revocable and limited right to access and use the Services, subject to the restrictions below. You may access and use the Services solely for your personal, non-commercial purposes.

Commercial use of the Services is prohibited. You agree that you use the Services within the scope of personal use.

The rights granted to you under this Agreement are subject to the following restrictions. You agree that you will not:

• license, sell, rent, transfer, distribute, copy, communicate to the public, publish, or otherwise commercially exploit the Services;
• modify, adapt, create derivative works of, reverse engineer, decompile, or disassemble the Services in whole or in part;
• access the Services to build a similar or competitive service or application;
• gain unauthorized access to, attack, or spread malware against Strata Studio's information systems;
• disable or alter the software Strata Studio uses for cybersecurity;
• send unsolicited invitations, advertising, or email on Strata Studio's behalf, or misuse its trademarks and logos;
• use the Services in violation of applicable law, third-party rights, or public morality.

Some of our Services use artificial intelligence to generate content ("Outputs") based on the text, images, audio, or other inputs you provide ("Inputs").

Your Inputs

You represent that you hold the rights necessary to provide the Inputs and that they do not infringe the intellectual property, privacy, or other rights of any third party. You grant us the permission needed to process your Inputs so that we can operate the Services.

Outputs

To the extent permitted by applicable law and provided you comply with this Agreement, you may use the Outputs you generate through the Services. Due to the nature of AI, you acknowledge that similar Outputs may be generated for other users.

Prohibited uses

You may not use the Services to generate unlawful, harmful, hateful, harassing, or obscene content or content that infringes others' rights; to impersonate real persons in a misleading way; or to violate applicable law.

The Services are not sold to you; you are granted only the right of use described above. All rights, title, and interest in the Services — including all intellectual property rights in the software, source code, designs, graphics, interfaces, models, text, and audio-visual elements — belong to Strata Studio or its licensors.

Unless expressly permitted in this Agreement, you may not copy, use, republish, modify, or distribute the copyrights, trademarks, and other proprietary rights displayed in the Services.

The Services may offer paid features, including subscriptions and in-app purchases.

Subscriptions and auto-renewal

• Your subscription automatically renews at the end of each period and the applicable fee is charged unless you cancel.
• To stop renewal, you must cancel through your app store account settings at least 24 hours before the end of the current period.
• Where offered, if you do not cancel before a free trial ends, the paid subscription begins.

Payments and refunds

• All payments are processed through platform providers such as the Apple App Store and Google Play (the "Platforms"). By making a purchase you also accept the relevant Platform's terms.
• Refunds are subject to, and generally handled by, the relevant Platform's policies.
• Prices and availability may change with or without notice; changes do not affect your current subscription period.

The Services are provided "as is" and "as available," without warranties of any kind, express or implied. Strata Studio does not warrant that the Services will be uninterrupted, error-free, or secure, that defects will be corrected, or that the Outputs will be accurate or fit for any particular purpose.

To the maximum extent permitted by applicable law, Strata Studio shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including loss of revenue, lost profits, or business interruption. Strata Studio's total liability arising out of this Agreement shall not exceed the amount you paid us for the Services in the six (6) months preceding the claim. If you have paid nothing during that period, your sole remedy is to stop using the Services.

You agree to defend, indemnify, and hold harmless Strata Studio from and against any claims, suits, damages, and expenses (including reasonable attorneys' fees) brought by third parties arising out of or relating to your use of the Services, your content, or your breach of this Agreement.

Strata Studio reserves the right to amend this Agreement at any time. The current version is always published on this page. Continuing to use the Services after changes take effect means you accept the updated version.

This Agreement enters into force on the date you activate or begin using the Services. It remains effective for as long as you use the Services and terminates if you stop using them or if Strata Studio terminates it. If you breach this Agreement, Strata Studio may suspend or terminate your access without notice.

This Agreement and all disputes relating to it are governed by the laws of the Republic of Türkiye, without regard to conflict-of-law principles. The Istanbul (Çağlayan) Courts and Enforcement Offices shall have jurisdiction over all disputes arising out of or in connection with this Agreement. For consumer transactions, the jurisdiction of the consumer courts and arbitration committees at the consumer's place of residence is reserved.

Strata Studio may notify you via postings on its website or within the apps, or via the email address you provide. You may send all notices under this Agreement to hello@stratastudio.app.
